4:20 Hemp & THC Ban, What’s Happening and What It Means for You

If you’ve been hearing more about a potential THC ban, you’re not alone. There’s been a lot of conversation, confusion, and concern around new legislation that could significantly impact the hemp and CBD space.

We want to take a moment to explain what’s happening in a clear and direct way, so you can better understand what this means for you and for the future of these products.

What’s Changing

A new law passed on November 12, 2025 is intended to close what has been known as the “hemp loophole,” originally created under the 2018 Farm Bill. That bill allowed hemp-derived products to be legally produced and sold as long as they contained no more than 0.3% THC.

Here’s what we know so far:

  • The law will go into effect on November 13, 2026
  • Products with more than 0.4 milligrams of total THC per container will be considered illegal outside of dispensaries
  • Products with more than 0.3% total THC, including THCA, will also be considered illegal
  • Cannabinoids that are synthesized or not naturally produced by the plant, such as delta-8 or HHC, will be considered illegal

This means that even products that have followed current legal standards may no longer be available in the same way.

Why This Matters

This isn’t just about products. It affects an entire ecosystem: farmers, small businesses, researchers, and communities that have built their work around hemp and CBD already face complex challenges. Changes like this could make it even harder to operate and, in many cases, may force businesses to close.

It also impacts access. Many people rely on these products as part of their daily routines for balance, stress support, and overall wellbeing. 

Is there still hope? 

There is still time, since the law does not go into effect until November 2026, and there are ongoing efforts to shift the conversation from banning to regulating. New bills have been introduced that aim to delay the ban and give space for better research, clearer rules, and more responsible regulation.

Many groups across industries are advocating for a more balanced approach that protects both consumers and the people behind these products.

What You Can Do

There is still a year until the new rules are applied and hemp advocates are hopeful that there is still time to help the government regulate hemp products instead of outright banning them.  Please call your local representatives to voice your opinion or alternatively use this link to select your state and contact your members of congress.
